1. Acceptance of Terms
By using this website, requesting a flight, or booking a charter, you (“Client”) agree to these Terms. If you do not accept these Terms, please do not use our site or services.
2. Booking, Payment & Quotes
All flight bookings are subject to aircraft availability and receipt of a signed contract and passenger details. Full payment is due at least 72 hours before departure (for domestic flights) or earlier, as specified. Late payment fees may apply.
3. Cancellation & Refund Policy
- Cancellations made more than 72 hours before departure will incur a 20% fee.
- Cancellations made between 72 to 24 hours before departure will incur a 50% fee.
- Cancellations within 24 hours of departure are non-refundable.
- Cancellations due to weather, regulatory reasons, or operational issues by ShahAir will be eligible for a full refund or rescheduling without additional cost.
4. Operational Disruptions & Force Majeure
ShahAir is not liable for delays, cancellations, diversions, or failures to operate caused by circumstances beyond its control, including but not limited to weather, air traffic control, mechanical failures, government orders, strikes, or force majeure events.
5. Passenger Conduct & Documentation
All passengers must possess valid government-issued identification and comply with customs, immigration, and aviation regulations. The Client is responsible for the accuracy of the passenger manifest and ensuring all passengers follow applicable laws and behave appropriately during the flight. ShahAir reserves the right to deny boarding for non-compliance or disruptive conduct.
6. Baggage Policy
Baggage allowances depend on the aircraft type and will be communicated before the flight. ShahAir is not responsible for damage or loss of baggage unless due to gross negligence.
7. Liability & Disclaimer
ShahAir provides all services “as is” and makes no warranties, express or implied, regarding uninterrupted or error-free service. ShahAir disclaims any implied warranties of merchantability or fitness for a particular purpose. Liability is limited strictly to the amount paid for the booked service. ShahAir shall not be liable for any indirect, incidental, punitive, or consequential damages.
8. Indemnification
You agree to indemnify and hold harmless ShahAir, its affiliates, employees, officers, agents, and partners from any and all claims, liabilities, losses, or expenses arising from your or your passengers’ use of ShahAir’s services, violation of these Terms, or breach of applicable laws.
9. Intellectual Property
All content on the ShahAir website, including but not limited to logos, graphics, designs, text, software, and layout, is the intellectual property of ShahAir or its licensors. Any use or reproduction of this content without prior written consent is strictly prohibited.
10. Insurance & Carrier Operators
ShahAir works with licensed and certified air carriers. While we ensure they maintain proper insurance, ShahAir is not responsible for the conduct, negligence, or operational decisions of such third-party carriers. Clients are expected to rely on the operator’s liability coverage as the primary source of recourse.
11. Third-Party Links & Services
The website may contain links to external websites or services. ShahAir is not responsible for their content, privacy practices, or functionality. Use of such third-party resources is at your own risk.
12. Dispute Resolution
Any dispute or claim relating to these Terms or use of ShahAir services shall be resolved first through mediation or arbitration within India. If unresolved, the courts located in Chandigarh and the jurisdiction of Punjab & Haryana will have exclusive authority.
13. Modification or Termination of Service
ShahAir reserves the right to modify, suspend, or terminate its website or any of its services at any time without prior notice. Updates to these Terms will be posted on this page with a new effective date. Continued use of the site or services indicates acceptance of the modified terms.
14. Entire Agreement
These Terms, together with any executed service agreements, privacy policies, and booking confirmations, constitute the entire agreement between you and ShahAir. Any amendments must be made in writing and signed by both parties.
